Approving Agreements with PSE pertaining to the underground conversion of its facilities located in 3rd ST SW
Approve two standard agreements required by PSE before beginning work related to the undergrounding of PSE facilities, and authorize the City Manager to sign the agreements in a form that has been approved by the City Attorney.
On October 16, 2012, the City Council authorized the execution of the design agreement with Puget Sound Energy to begin the design of converting PSE's 3rd Street SW overhead facilities into an equivalent underground system. PSE completed the design earlier this year which was incorporated as two bid alternates within the City's 3rd Street SW contract. On April 9, 2013, the City Council awarded the 3rd Street SW construction contract base bid and all bid alternates, including the underground conversion work. Work under the design agreement has expired and PSE now requests that the City execute two standard agreements (one for the project plan and the other for project construction) prior to beginning the construction phase.
The project plan consists of the construction drawings and specifications and requirements of PSE which were incorporated into the City's construction contract. The project plan also includes a work schedule, construction cost estimate, and a detailed breakdown of the responsibilities of each party.
The project construction agreement outlines the separate obligations of the City and PSE during the conversion process. The City is responsible for ensuring that its contractor: constructs the joint utility trench in conformance with PSE standards, oversees the work, and coordinates with other utilities. PSE will provide conduit and vaults, and its inspectors will monitor the work done by the City's contractor. After the City's contractor has installed the conduit and vaults, PSE or its contractor will pull wire and energize the underground system. The project plan includes a work schedule, cost-sharing criteria, dispute resolution, termination procedures, and insurance requirements.

PSE requires that these two standard underground conversion agreements be executed before proceeding to construction. If the agreements are not approved, the underground conversion of PSE's overhead facilities in 3rd Street SW cannot occur.
