Recommended Action
Authorize and grant an easement to Michael and Robin King, owners of property at 1404 18th Street NW, said easement to provide access over and across unused city property adjacent to the Treatment Plant for the purposes of ingress/egress and vegetation management; and further authorize the City Manager to execute the easement in a form that has been approved by the City Attorney.
Background
The  City purchased parcel no. 0420204256 in the 1400 block of 18th Street NW for the future expansion of the Water Pollution Control (Treatment) Plant.  Inclusive of this parcel is a "panhandle" that is approximately 22' wide and 167' long, running east to west.  Michael and Robin King own the parcel immediately north and adjacent to this "panhandle" and have been maintaining this area (grass/vegetation trimming) since their 1998 purchase.

Mr. and Mrs. King approached the City requesting permission to fence this area due to their concern that it may allow easy access for vandalism and theft on their private property. City staff, including the city's Treatment Plant Supervisor, appreciate the King's willingness to maintain this unused area adjacent to the plant and are supportive of granting an easement which will allow the Kings to not only continue to maintain this property, but also enhance the security of their own property with the installation of additional fencing and a gate.

Staff's recommendation of approval is subject to the following conditions: 1) The property is to be maintained by the Kings, to include mowing of grass and maintenance of vegetation/shrubbery/trees in order to ensure that the area is passable for vehicular use by the City if necessary in the future; 2) Fencing along the southerly property line and across the 18th Street NW frontage would be allowed as long as the city's treatment plant staff are provided a key to access through any locking gates installed as a part of the fencing; and 3) The Kings will hold the city harmless against any and all claims in their use of the property.

Summary of Proposal

Alternatives/Options
If the City Council does not wish to grant the requested easement, City staff would need to commence maintenance of this area.
