Recommended Action
Approve Professional Service Agreements for Towing and Impound Services with Gene’s Towing Inc. and Herb’s Towing and authorize the City Manager to sign such agreements substantially in a form as approved by the City Attorney.
Puyallup Municipal Code 5.80.130 acknowledges the ongoing need for towing and impound services within the City and authorizes the police department and public works department to prepare contract specifications to meet such needs. The Puyallup Municipal Code also addresses the conditions under which towing services are to be provided, such as when the police department or public works department requests a disabled vehicle be removed from a city street. Recognizing the need for timely and efficient towing and storage services, PMC 5.80.130 allows the City to enter into contracts with multiple tow operators.

On June 19, 2013 a Request for Proposals (“RFP”) was advertised in the Puyallup Herald and on the City’s website. The request for proposals stated, amongst other requirements, that to be eligible to provide service to the City the contractor must have been in business as a registered tow operator, as approved by the Washington State Patrol (WSP), for a minimum of two consecutive years and further that the contractor agrees to maintain an approved storage facility within the city limits of Puyallup. A copy of the current WSP fees is included in an attachment to this agenda item.

Two companies, Gene’s Towing Inc. and Herb’s Towing responded to the RFP by the posted deadline of July 3, 2013.

Staff recommends approval of professional services agreements with Gene’s Towing Inc. and Herb’s Towing. Having multiple tow contractors, which is our current practice, leads to improved response times and enhances service to the citizens of Puyallup.
Previous Actions (Discussions/Presentations)
The last Towing and Impound Services Agreement was passed by the Council on July 13, 2010. If approved, this agreement would replace the previous agreement.
Summary of Proposal
There is a need to update our Towing and Impound Services Agreement due to a change in conditions. An RFP was posted and two companies responded. Staff recommends that Council authorize the City Manager to enter into contracts with the two listed companies who meet the conditions of the RFP.
If this agreement is not passed, the Puyallup Police Department would need to continue to operate under the old RFP; however, the old contract does not contain the current fee structure or the City’s standardized professional contract language.
