Recommended Action
Approve and award a contract to RS Underground, Inc. in an amount not to exceed $190,010 for the construction of Porous Alleys Project: 6th Avenue SW & Wilson Drive NW, and authorize the City Manager to execute the contract substantially in a form as approved by the City Attorney.
Background
The City was awarded a Statewide Stormwater Grant from the Department of Ecology to retrofit existing impervious alleyways with porous asphalt surfaces in an effort to reduce stormwater runoff to our local waterways. The grant has allowed certain small streets, such as 6th Avenue SW and Wilson Drive NW, to be included in this project. When Council accepted the grant on August 14, 2012, 6th Avenue SW and Wilson Drive NW were identified as two of the six retrofit locations.

This project supports implementation of the Clarks Creek fecal coliform and dissolved oxygen total maximum daily load (TMDL) documents for which the City must implement projects to reduce untreated stormwater runoff to Clarks Creek. Implementation of Low Impact Development projects such as porous alleys was identified in the 2012 Elodea Task Force's "Solutions Memorandum" as a long-term solution to supporting reduction in sediment and other pollutant loadings to Clarks Creek through surface flow reduction.
Previous Actions (Discussions/Presentations)
On August 14, 2012, Council accepted the Washington State Department of Ecology Statewide Stormwater Grant in the amount of $665,000 for use in addressing stormwater issues and water quality impacts in the Clarks Creek and Puyallup River basins resulting from stormwater runoff from impervious surfaces.
Summary of Proposal
Staff recommends that Council award the contract for construction of porous alleys on 6th Avenue SW and Wilson Drive NW to RS Underground, Inc. as the responsible and responsive low bidder for the project.
Alternatives/Options
Pursuant to the public works laws of Washington State, the city sought competitive bids for this project and five firms submitted bids. After staff review of the bids, RS Underground, Inc. was determined to be the lowest responsive and responsible bidder. This project is a demonstration project of Low Impact Development best demonstrated practices as applied to public alleyways and relatively small public streets. The majority of the funding for this project is provided by a Department of Ecology grant, which would not have been available for a conventionally-designed local street or alleyway. Further, matching funds for this project are being provided by the stormwater utility, as the road itself is becoming the stormwater system. Street funds were not available as a match for this project.

Washington State Department of Ecology Statewide Stormwater Grant for the Porous Alley Initiative project in the amount of $665,000. Stormwater funds were budgeted to meet the 25% match requirement for this grant.

*This contract will construct two of the eight porous alleyways expected to be achieved under this funding.

**Ongoing staff costs for the retrofit streets will remain unchanged from current efforts. The streets will continue to be vacuum swept as part of the City's existing maintenance program.
