Recommended Action
Conduct second reading of an ordinance that amends Ordinance No. 2923 to remove certain performance standards that are extraneous to base RS-08 zoning.
Background
On April 9, 2013, City Council considered a request from the owner of a 10.5 acre property located on Fruitland Avenue  (aka Fruitland Estates plat site) to revisit verbiage which had been incorporated into the 2008 ordinance (No. 2923) that established zoning for the West Hills annexation area.   As outlined in more detail in the agenda material for that meeting, City Council (on 11/18/08) had adopted this annexation zoning ordinance which assigned the City's RS-08 zoning to the above-cited property.  Based upon input from the former property owner during that hearing, caveats had been included in the ordinance relating to Fruitland frontage treatment and inclusion of single-story units for this property.   The current owner was requesting that those earlier "caveats" not be made applicable to their ongoing property subdivision. 

On April 9, 2013, by a 7-0 vote, City Council directed staff to return with an ordinance amendment to remove the verbiage in Ordinance No. 2923 referencing the single-story unit/street frontage standard.   Consistent with that vote, the attached ordinance eliminates that text.

City Council approved first reading of this ordinance on April 16, 2013.
