Provide direction on the processing of a proposed development agreement for the East Town Crossing project, located at the southeast corner of Shaw Road and East Pioneer.
Background
Puyallup Municipal Code Sec. 1.15 provides for City Council review of and action on development agreement requests. As established by state law, a development agreement is essentially a contract between a property owner and municipality as to specific terms of a site development. PMC Section 1.15.030 allows the Council to grant flexibility on development standards, subject to a finding of public benefit. 

Greg Helle, one of the owners of the 9.2-acre commercially-zoned property at the southeast corner of Shaw and Pioneer, recently submitted a development agreement request for this site. The property has been the subject of a not-yet-approved binding site plan request for a commercial development known as East Town Crossing. This property was the focus of a prior development agreement approved in early 2009 (which has since expired); it is also subject to the Shaw-Pioneer zoning overlay (SPO). As outlined more fully in the attached staff memo, the current request seeks flexibility both as to use (the property owners wish to build a large multi-family residential component on the eastern side of the property) and with respect to multiple site standards of the SPO overlay. The primary public benefit would be provision of some affordable units within the development.

The City Council is required to hold a public hearing before taking action on a development agreement request. PMC Section 1.15.055 gives Council the option of referring a development agreement to the Planning Commission for input prior to holding the public hearing, and the previous 2009 development agreement for this site was reviewed by the Planning Commission. Alternatively, Council could direct staff to proceed directly to a public hearing at a City Council meeting.
Previous Actions (Discussions/Presentations)
This particular property has not been the subject of specific City Council action in recent years. As noted, a prior development agreement was approved by the Council in early 2009. More recently, the Council has addressed the Shaw-Pioneer Overlay (SPO) zone relative to properties north of East Pioneer.
Summary of Proposal
The owner of the commercially-zoned property at the southeast corner of Shaw Road and East Pioneer requests City Council consideration of a proposed development agreement to allow deviations from several standards of the base and overlay zoning. Staff requests Council direction on the processing of this agreement request.
Alternatives/Options
