Recommended Action
Recommend approval of an easement across City-owned property in favor of Willows Capital, LLC in a form substantially as approved by the City Attorney.
One of the accesses to the Willows Shopping Center was relocated during the 39th Avenue SE Extension project such that it is now located on a City-owned parcel. It is the intent of the City to surplus this property upon closure of the 39th Avenue SE project. This easement serves to legally establish the access use by Willows Capital LLC across this property so the access will continue after any ownership change.

Summary of Proposal
This action would grant an easement to Willows Capital, LLC to ensure the continuation of a current access to the Willows Shopping Center. This access is now provided across a City-owned parcel; however, the City intends to surplus this property in the near future as it is no longer needed as public right-of-way.
Granting this easement will ensure this access is continued if and when this City-owned parcel is surplussed and changes ownership.

The extension of 39th Avenue SE was designed in such a way that this access is currently provided across City-owned property.
